As a criminal defense attorney in Colorado Springs and Teller County, I handle all types of criminal matters including traffic tickets. Often people will call me and ask whether they need an attorney to represent them.
My standard advice is that any person charged with a ticket six points or higher may benefit from the assistance of an attorney. The reason is that an adult driver (over 21 years of age) cannot receive 12 points or more in a year period, and 18 points in two years. If a person receives 12 points or more than that person’s license will be suspended for up to 1 year. Any charge that involves half of the points allowable in a year period is serious enough to involve an attorney.
Often for a first time offender, depending on the court, there is more likelihood of getting no points in exchange for a driving class or a larger fine. In traffic cases, such as careless driving and reckless driving, the charge is based on the law enforcement officer’s subjective opinion that the law has been violated. Often with the help of an attorney, you can prevail in such cases.
